The legal basics

A settlement agreement is a legally binding way to end employment on agreed terms, almost always involving a payment in exchange for the employee agreeing not to pursue certain claims against the employer. The Employment Rights Act 1996 sets out what’s required for the agreement to be valid: it has to be in writing, it has to relate to specific claims or proceedings, and the employee has to have received independent legal advice before signing. You may still hear these called compromise agreements; the name changed back in 2013.
